GO MOBILE FLOORING INSTALLATION AND MATERIAL SPECIFIC TERMS AND CONDITIONS AND POLICIES
All sales of products (“Products”) and services (“Services”) provided by Go Mobile Flooring, LLC (the “Company”, “our” or “we”) to you (“you” or “Customer”) shall be subject to these special terms and conditions (“Material-Specific Terms and Conditions”). These Material-Specific Terms and Conditions are incorporated in our Term and Conditions. In the event of any inconsistency or conflict between these Materials-Specific Terms and Conditions and Term and Conditions, the terms of these Material-Specific Terms and Conditions shall prevail. By agreeing to our Terms and Conditions, you are agreeing to the terms and conditions and policies set forth in these Material-Specific Terms and Conditions. Any capitalized terms included herein but not defined shall have the meanings set forth in the Terms and Conditions.
By agreeing to any quote or proposal for Products and/or Services, or by signing these material-specific terms and conditions, you agree to be bound the these Terms and Conditions. If you do not agree to any portion of these Terms and Conditions, you should not engage Company for the provision of Products or Services. General Terms of Installation. Subfloor problems and or floor preparation, which are not foreseeable at the time of measuring, will be an additional charge and will be added onto the balance owing. Company will create a change order for such issues, which will be due at the time of acceptance. Cutting off doors and any other carpentry work is the sole responsibility of the purchaser. Technicians will remove interior doors if cutting is necessary. A change order can be requested based on each project; however, technicians are limited in the type(s) of doors to which they can make modifications. Company will not be held liable for any damages sustained during the removal of baseboards, including without limitation, damage to sheet rock, walls, paint, trim, or baseboard replacement. We only removed baseboards if we are installing new baseboards. We can never know how existing baseboards were installed and what type of nail or screw was used to fasten to wall. Customer shall be held responsible for all cost incurred to repair or replace said damages. Company technicians will help move and replace normal household furnishings; however, Company technicians are not professional movers – rather, they are professional floor technicians; therefore, Company is not responsible for damages that may occur to furniture, appliances or existing flooring. We pride ourselves on being very careful with your belongings. If we are the obvious cause of damage beyond reasonable doubt, we will take care of said damage.
Trims. Existing door casings and baseboards might have gaps due to difference in thickness from existing to new floors. Additional trims can be added for additional cost.
Carpet. Today’s hot-melt seams are as strong as the rest of the carpet; however, seams are not invisible. Berber and pattern carpets shows seams more than most other types of carpet. Payment of invoices shall be made regardless of defect or damage. If there is defect or damage, Company will create a claim with the manufacturer for defect or damage, but you will not request any deduction, reduction or change in prices for any inconvenience. Flooring technicians take great pride in their work and will do their very best to make your seams as inconspicuous as possible. Unsatisfactory carpet appearance caused by improper maintenance, use of harsh cleaning agents, improper cleaning procedures, or exposure to household chemicals is not considered and shall not be construed to be a defect and is not basis for claims. Any “on location” alterations in carpet appearance (soil retardant, anti-static, anti-microbial) after the carpet is installed is not a basis for claim. If Company does not supply the carpet, we cannot guarantee the quality of the carpet or seams. There is no warranty on carpet that is being reused. It is the responsibility of the Customer to make sure all procedures are maintained for all warranties to be upheld. Many manufactures offer performance warranties. Most warranties state that after a specified number of years a certain percentage of the carpet fiber will still be intact; they do not promise what the carpet will look like new (nothing stays new forever). After 6-12 months, any carpet will begin to show high traffic patterns. Many manufactures offer stain warranties. Television commercials make stain removal appear to be an easy and simple process; this is not always the case. Some stains will require hours of effort to remove, and still possibly not come out. Any local fire authority approval required for floor covering purchased must be obtained by the customer.
Real Wood and Prefinished. Hardwood is a product of nature and no two pieces of wood are exactly alike. Each lot has different markings, variations, and shades, this is not considered a defect. Customer is aware that wood products can be adversely affected by too little or too much humidity and or moisture, and herby accepts responsibility for any damage occurring because of adverse job site conditions. Customer is aware that job site temperature along with moisture, expansion, shrinkage, cupping, buckling, or other reaction of wood to moisture, or dryness without regard to size grade, or previous condition of the material. Customer is aware that sanding of wood products will create fine dust in the air. Purchaser is aware that lacing onto an existing wood floor cannot be matched exactly. If Customer fails to remove moisture or fails to maintain the required or recommended humidity for any flooring or subflooring, such omission or failure shall void the warranty of labor and materials from manufacturer. If damage results to flooring as a result of product or services not delivered by Company, such activity shall voice the warranty of labor and materials from manufacturer. Custom Trims and Solid Stair Treads can vary in color, grain pattern, and hand scraping. We coordinate the closest color possible when custom making it; any variation in color or pattern is not considered a defect or imperfections as wood is a natural product and will always vary from piece to piece.
Tile and Stone. Customer is aware that the removal and installation of tile products will create dust in the air and Customer has taken such precautions as he/she feels adequate to protect the surrounding area from the dust. Company shall not be held liable for any damages sustained during the removal of tile. This includes but is not limited to damage of sheet rock, walls, paint and trim. Customer shall be held responsible for all cost incurred to repair or replace said damages. Stone is a product of nature and no two pieces of stone are exactly alike. Each stone has different markings, variations, and shades. They also differ in their moisture absorption, finish and texture. These are not defects but rather inherent characteristics of stone products. All stone and tile products should be sealed with a penetrating sealer. They will need to be resealed periodically to keep the life of your tile and stone up to date. Grout sample colors shown may vary from actual grout. Final installed shade can differ based on tile type, porosity, job site conditions and finishing techniques.
Visual Shade Disclosure. Variations in shade and finish are inherent to porcelain, ceramic, stone and glass products, and current stock may vary from actual samples. Natural stone products in particular possess inherent characteristics which, by nature, include but are not limited to extreme variations in coloration, shading, and structure.
Vinyl, Vinyl Plank, and VCT. Fading or discoloration can occur with repeated exposure to direct sunlight. High traffic areas may suffer gloss reduction. Gloss levels will reduce if the floor is scratched or abraded. High heeled shoe indentions, excessive moisture, rips, gouge, tears and piercing are considered as accidental abuse of the products and are not covered under warranty. No warranty claim will be made if non-compliant underlayment is used.
HVAC. Company will not be held responsible for flooring failures due to homes and businesses not properly maintaining temperatures ranging of 60° to 75° Fahrenheit before, during and after job completion. Humidity should range between 30%-50%. Moisture meter should be measured with a Tramex Concrete Encounter with reading ranging from 0%-3.5%. If it is higher, it is required to have a sealer which will be an additional charge.
Plumbing and Appliances. When plumbing disconnection is required, we will not be held responsible if any seals or pipes are broken and we will not be held responsible for any damage due to leaks or flooding. Gas appliances and/or toilet back must be installed by a license plumber. We recommend always hiring a plumber for any disconnection required.
Cabinetry. Cabinetry is constructed from several pieces of solid wood and wood veneers on plywood. Differences in grain pattern and color should be expected. Wood characteristics naturally occurring such as variations in color, grain, mineral streaks and knots are not considered defects. Color variations and color softening in cabinets are a natural occurrence due to species, age, character of cabinets, and exposure to UV light and sunlight. For these reasons, new and/or replacement cabinets may not match display samples. Such variations and changes are not considered defects. Cabinetry distressed finishes are designed to mimic the wear and aging of actual furniture antiques by highlighting the effects of random wear and use. In the process of distressing and glazing, we make every effort to maintain uniform appearance of aging, however, it is important to understand that no piece of furniture can be duplicated exactly through the process of distressing and/or glazing. Glazed finishes will have variations in glazing residue as a result of the glazing process and hand rubbing produces that cause the effect of wear and aging. The overall look of your completed cabinetry may vary slightly from that of a single door sample, which is intended as part of the process.
Measurements and Blueprints Furnished by Customer. If any project or Services are based upon measurements or blueprints furnished by the Customer, the price indicated in any accepted Proposal is subject to change, including extra trip charges, should the actual measurements vary from those submitted. Should a condition exist or be found at the site of installation, which was not readily apparent at the time of purchase or measure, any accepted Proposal may be modified to increase or decrease the purchase price to rectify the condition. Customer agrees that verbal confirmation by Customer of changed prices shall be binding. Under no conditions is the Customer to pay the installer/technician/contractor directly for any extra labor, as we cannot warranty such labor — this is against Company policy and may cause termination of your agreement with Company.
Underlayment of Labor. The amount of underlayment of labor is sold compatible to measurements of the floor covering. In some instances the amount of underlayment may be less. We have taken this variation into full account in establishing our prices.
Manufacturer Backings. Manufacturers are permitted to change backings. This will not affect quality. A two percent (2%) variance in carpet width is within tolerance. Shading, shedding, fluffing or pile crushing are not manufacturing defects, but inherit characteristics of all fabrics. Shade may vary from sample seen in showroom.
Shoe Molding. When it is part of the accepted Proposal, Company technicians will exercise every care possible in removing and reinstalling shoe molding but cannot be responsible for breakage or other damage to molding. Customer is responsible for providing shoe molding due to breakage or where new molding is required. Additional shoe molding shall be at additional cost. Should your doors require adjustment due to new flooring, please make arrangements with your carpenter. If our installation team can perform a door modification, we will create a change order. Company does not offer any warranty on door modifications. Stairs are not covered from wall to spindles, unless otherwise specified in this contract. If railings are to be removed, this must be done by the Customer before the Company technician arrives, unless otherwise stated in the contract. Neither the Company technician nor the Company can be responsible for scoring or abrasions of baseboards or door frames due to knife cuts for the reason that additional carpet must be cut to allow for tuck-in on tackles installations. It is the Customer’s responsibility to detach any intricate wiring such as stereo, TV, cable or any computer equipment, etc. We cannot be responsible for any wiring that runs under floor coverings.
Countertops. Customer acknowledges that countertop products have natural variations, veining, and each piece is unique. Furthermore, Customer acknowledge that breakage can occur, delays in fabrication can occur, and seams are not invisible. Countertop Surfaces are stone products which will not crack unless an external force or interaction causes the crack such as impacts, structural settling or movements, thermal shock from the use of crock pots, skillets or other hot items placed directly on the countertop, improper conditions in the home may cause the countertop to shift. Therefore, cracks are not covered by this or any warranty. Caution: Do not use crock pots, skillets or other hot items directly on your countertop surface. Always place them on a trivet or cutting board to protect your countertop from thermal shock. Countertop warranty does not cover any additional or supplemental repairs or modifications such as, any plumbing, electrical, tile or wall surface modifications that may be necessary to repair or replace countertop under manufacturer’s warranty; such other repairs and modifications shall be the responsibility of the customer. Manufactures warranty does not cover products that have not been paid for in full. Manufacture does not cover products exposed to abnormal use or conditions or abuse in any way. “Abnormal use or conditions” includes, but is not limited to, damage from mishandling or misuse, damage from excessive heat, scorching or exposure to weather conditions, exposure to ultraviolet light, physical or chemical abuse, acid etching, staining or damage from improper care and maintenance or damage from chipping, cracking, impact damage or breaking due to customer abuse. Countertops are intended to have a natural and non-uniform appearance, manufacturer does not warranty and does not cover any variances in color, shade, particle structure or gloss level. Manufacture warranty does not cover products that you, the customer, decide you do not like after installation due to color, edging styles or other opinions based on personal preference. It does not cover seam appearance or performance, metal marks, fingerprints or smudges or other temporary marks made by household utensils. Manufacturer does not cover “commercial uses” on countertop products. “Commercial uses” include but are not limited to use in commercial buildings such as retail stores, restaurants, offices, hotels, or apartment complexes. It does not cover outdoor uses.
Natural Stone. Customer acknowledges that stone is a natural substance, formed within the earth, and that different types of stone, as well as individual stones within any given type, may vary in texture, color, thickness, density, durability or fitness for a particular use or purpose. Because natural stone may chip, peel, flake, bleed, stain, oxidize or otherwise deteriorate over time, all of these attributes should be considered when using stone, especially in any exterior application subject to moisture. Customer acknowledges that Company has no control over Customer’s selection or use of any stone, and that exposure to weather, installation techniques or preservative measures used by Customer or its installer all may affect the long-term performance and durability of any stone selected and/or installed by Customer. Ice-melting salt and other ice-melting products adversely affect natural stone. We recommend that you DO NOT use these products on or near natural stone. Especially in the case of cut natural stone (patterned, steps, etc.), we recommend using a stone sealer to assist with durability and longevity. Customer’s purchase of stone from Company constitutes Customer’s acknowledgment of the above, and acceptance of the risks inherent in the use and installation of this natural substance and a waiver of any and all claims which Customer may have against Seller arising from the chipping, etching, flaking, staining, bleeding, oxidation, or other deterioration of this natural substance.
